Terms of Service

These Terms of Service (“Terms”) govern your use of Hirecast (“Service”), operated by FifthNexus LLC (“we,” “us,” “our”). By subscribing to or using Hirecast, you agree to these Terms.
1. The Service
Hirecast provides managed OpenClaw hosting with AI capabilities included. We handle the infrastructure, model selection, and configuration. You get a working OpenClaw agent.
We may change the underlying AI models, infrastructure, providers, and technical configuration at any time without notice. Our model selection is proprietary. We continuously benchmark and optimize the AI powering your agent. You will not always be notified of changes, but we aim to maintain or improve quality.
2. Accounts and Billing
- Subscriptions are billed monthly at the current rate (currently $49/month USD).
- Payment is charged at the start of each billing period.
- You may cancel at any time. Cancellation takes effect at the end of your current billing period. No refunds for partial months unless we terminate your account (see Section 7).
- We may change pricing with 30 days’ email notice. If you don’t agree to new pricing, you may cancel before it takes effect.
3. Acceptable Use
You agree not to:
- Use the Service for any illegal activity
- Send spam, bulk messages, or unsolicited communications through your agent
- Attempt to bypass, disable, or circumvent security controls
- Attempt to access other customers’ data, workspaces, or agents
- Attempt to reverse-engineer our infrastructure, model selection, model training, or any proprietary technology
- Use the Service to harass, threaten, or harm others
- Overload the Service with automated requests designed to degrade performance for other users
- Resell or redistribute access to the Service without our permission
We reserve the right to determine what constitutes a violation of these terms.
4. AI Disclaimer
The AI can be wrong. Your agent is powered by AI language models that may:
- Produce inaccurate, incomplete, or misleading information
- Hallucinate facts, actions, or results
- Misunderstand instructions or context
- Take unintended actions when using tools or skills
You are solely responsible for reviewing and acting on any output from your agent. Hirecast is not responsible for any decisions, actions, or consequences arising from AI-generated content. Do not rely on the Service for medical, legal, financial, or safety-critical decisions.
5. Data and Privacy
- What we store: Your agent’s conversation history, workspace files, configuration, and Telegram bot token.
- What we don’t do: We do not sell your data. We do not use your conversations to train AI models.
- Third-party processing: Your conversations are processed by AI models to generate responses. These models may be third-party, open-source, or proprietary to Hirecast. We do not disclose which models or providers we use. Third-party providers may have their own data handling policies.
- Isolation: Each customer’s agent runs in an isolated environment, separated from other customers.
- Deletion: Upon account cancellation, we delete your data within 30 days. You may request immediate deletion by emailing support@gethirecast.com.
6. Availability
We make commercially reasonable efforts to keep the Service available, but we do not guarantee any specific uptime percentage. The Service may be temporarily unavailable due to maintenance, updates, infrastructure issues, or circumstances beyond our control.
We are not liable for any downtime, data loss, or service interruptions. We do not offer uptime SLAs or service credits.
7. Termination
By you: You may cancel your subscription at any time. Your agent will remain active until the end of your current billing period.
By us: We may terminate your account at any time, for any reason, with or without notice. If we terminate your account:
- You will receive a prorated refund for the unused portion of your current billing period.
- Your data will be deleted within 30 days.
Service discontinuation: If we discontinue the Service entirely, we will provide reasonable notice and prorated refunds for unused subscription time.
8. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability to you for any claims arising from or related to the Service is limited to the amount you paid us in the 3 months preceding the claim.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, profits, or business opportunities.
- We are not liable for any actions taken by your OpenClaw agent, including messages sent, information provided, or tool actions executed.
- We are not liable for any third-party services your agent interacts with.
9. Indemnification
You agree to indemnify and hold harmless FifthNexus LLC, its members, and its agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or any actions taken by your OpenClaw agent.
10. Changes to Terms
We may update these Terms at any time. We will make reasonable efforts to notify you of material changes. Continued use of the Service after changes take effect constitutes acceptance. If you disagree with updated Terms, you may cancel your subscription.
11. Governing Law
These Terms are governed by the laws of the State of California. Any disputes will be resolved in the courts of Contra Costa County, California.
